WATER PURCHASE AGREEMENT FOR RESIDENTIAL PROPERTIES

THIS CONTRACT, for the purchase of drinking water is entered into as of the __________ day of _______________, by and between Aqua Feeling PVT Limited, whose address is Shinka Plaza, 1st Floor, Block-A, Main PWD Double Road, ISLAMABAD, Postcode 44000, hereinafter referred to as “Seller”, and Mr/Mrs/Company _____________________, an individual under the laws of Pakistan, with its principal place of residence of ______________________________________, City, _______________________________hereinafter referred to as “Purchaser”.

SALES:Seller hereby agrees to provide to Purchaser during the term of this contract or any renewal or extension thereof, treated water meeting applicable purity standards for the Provinces of Islamabad.

1. The first 150 days from the date of the contract will be offered under the initial OFFER of RS 150.00 per bottle refill and will then revert to paragraph 2 rate thereafter (below).

2. Seller hereby agrees to provide to Purchaser at the rate of below after the initial discounted rate:

3. It is further agreed that water rates may be adjusted after the guaranteed period specified in paragraph 1 above, with the condition that any rate increase shall be made in conjunction with general rate increases made by Seller to its other water users. Rate increases to Purchaser shall reflect the increased costs of water production, including increased cost of power, water treatment chemicals, and other direct costs related to the production of water for Purchaser over the present costs thereof Rate increases to Purchaser shall further reflect overall increases in direct and administrative costs of water production (costs including but not limited to labour, supplies, repair, fuel, power, transportation, employee benefits, contractual services, well repairs, replacement and treatment plant upkeep, and general allocable administrative expenses).

4. The original term of this Agreement is for 180 days minimum.

5. Notice to be given will be 30 days after the initial 180 days.

6. The deposit for each bottle is set at Rs 750 per bottle and if you have existing bottles which are in a good/reasonable condition then we will take those bottles from you and replace them with our bottles, so no deposit is then required. This will mean that the bottles which have been taken from you will become our property and our bottles will replace them. You have given Rs _________ deposit for_____ bottles. پانی خرید کی معاہدہ برائے رہائشی پراپرٹیوں

اس معاہدے کا دستخط کرنا، پینے کے پانی کی خریداری کے لیے __________ کے دن سے شروع کیا گیا ہے، اس دن کے بعد ______________ کو، جو Aqua Feeling PVT Limited، جس کا پتہ Shinka Plaza، 1st Floor، Block-A، Main PWD Double Road، ISLAMABAD، Postcode 44000 ہے، یہاں پر “فروخت کنندہ” کہلائے گا، اور انڈیوڈوال یا کمپنی _____________________، جو پاکستان کے قوانین کے تحت ایک فرد ہیں، اور ان کا مقامی رہائشی پتہ ہے ______________________________________، شہر، _______________________________ یہاں پر “خریدار” کہلائے گا۔

فروخت: فروخت کنندہ یہاں پر اتنے دورانیے کے لئے خریدار کو فراہم کرنے کا اتفاق کرتا ہے یا اس معاہدے یا اس کے کسی دوبارہ بنانے یا توسیع کے دوران تمام عمل کیلئے درست معیار کے پانی کی پیشکش۔

عقد کی تاریخ سے پہلے 150 دنوں کی پہلی پیشکش میں ایک بوتل کی دوبارہ بھرائی کی قیمت 150.00 روپے ہوگی، اور پھر اس کے بعد مذکورہ ذیل پر کراچی 2 کی شرح پر منتقل ہوگی۔
فروخت کنندہ یہاں پر ابتدائی رعایتی شرح کے بعد خریدار کو درج ذیل شرح پر فراہم کرنے کا اتفاق کرتا ہے:

اس سے اور بھی اتفاق ہے کہ پانی کی شرحوں کو پاراگراف 1 میں مخصوص مدت کے بعد ایڈجسٹ کیا جا سکتا ہے، اس شرط کے ساتھ کہ کوئی بھی شرح بڑھائی فروخت کنندہ نے اپنے دیگر پانی کے صارفین کو کردی ہو ۔ خریدار کو بڑھتی ہوئی پانی کی پیداوار کی مقامی شرحوں کے بڑھنے کو ظاہر کرے گی، جو بجلی، پانی کی علاجی کیمیکل، اور دیگر براہ راست لاگتوں کے بڑھتے ہوئے ہیں۔
اصل معاہدے کی مدت کم از کم 180 دن ہے۔
اعلان کرنے کی مدت اصل 180 دنوں کے بعد 30 دن ہوگی۔
ہر بوتل کے جمع کا رقبہ 750 روپے فی بوتل ہے اور اگر آپ کے پاس موجودہ بوتل ہیں جو اچھے / مناسب حالت میں ہیں تو ہم ان بوتلوں کو آپ سے لیں گے اور انہیں اپنی بوتلوں کے ساتھ بدل دیں گے، تو پھر کوئی جمع رقبہ درکار نہیں ہوگا۔ یہ یہ مطلب ہوگا کہ جو بوتل آپ سے لی گئی ہوں گی وہ ہماری ملکیت بن جائیں گی اور ہماری بوتلوں سے ان کی جگہ لیں گیں۔ آپ نے _________ بوتلوں کے لئے _________ رقبہ دیا ہے۔ آپ نے _________ بوتلوں کی بدل کے ساتھ کوئی جمع رقبہ نہیں دیا ہے۔

یہ بھی مفہوم اور متفق ہے کہ حصوں کی نیت کو معاہدے کو بڑھایا جانا ہے اور یہ ایک 30 دنی بنیاد پر ہو گا۔
یہ معاہدہ پارٹیوں، ان کے وارثوں، اور مخصوص کرنے والوں پر بندی ہوگا۔
